Terms and Conditions of Sale
Article 1: Application of the terms and conditions of sale
These Terms and Conditions of Sale apply throughout French territory and concern all orders placed on the website manufacturemayaud.fr. Purchasing a product on manufacturemayaud.fr implies your full and unreserved acceptance of these terms. As changes may be made to these terms, the applicable terms and conditions of sale shall be those in force on the website on the date the sales contract is concluded.
Article 2: Prices
The prices in force are those displayed on the website; they are inclusive of all taxes (i.e. including 20% VAT), in euros, but do not include shipping costs. These prices may be revised at any time. The prices of our 18-karat gold jewellery in particular are likely to change very regularly, as they are directly indexed to the price of gold.
Shipping costs are calculated at the end of the ordering process and depend on the weight of the parcel and its destination.
Article 3: Orders
To place an order on manufacturemayaud.fr, the customer must provide all the information required for invoicing and delivery. ORFEVA cannot be held responsible for non-delivery of the order if this information is incomplete or incorrect.
In the event of a return, the shipping costs for a new dispatch shall be borne by the customer.
The customer will receive an email confirming that their order has been received. Should ORFEVA be unable to fulfil the order placed, the customer will be informed by email within 3 working days.
Article 4: Delivery times
The delivery times indicated on product pages are given for information only. The company cannot be held liable if the times are longer, and the customer may not refuse the goods or claim damages. Delivery is deemed to have taken place upon handover of the goods to the customer, who must check their conformity.
Article 5: Force majeure
ORFEVA shall be released from all liability in the event of non-performance due to force majeure.
Article 6: Right of withdrawal
In accordance with Article L. 121-20 of the French Consumer Code on distance selling, the consumer has a period of fourteen clear days to exercise their right of withdrawal; however, the consumer remains liable for the cost of returning the goods.
The withdrawal period runs from the customer's receipt of the goods.
Article 7: Personalised orders
In accordance with Article L. 121-20-2 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalised; such goods will therefore remain invoiced to the customer.
Article 8: Payment
The order is taken into account at the time of payment.
ORFEVA, trading as Manufacture Mayaud, may refuse to process the order if the payment provider declines it.
The customer has several options for paying for their order:
- Bank card (Visa, Mastercard): our secure payment is handled entirely by the secure PayPlug system, which belongs to the Banque Populaire Caisse d'Epargne group. All information is encrypted and transmitted directly to PayPlug without passing through our website. You can tell that the transmission is encrypted by software when the padlock symbol appears in your browser. In addition, on the window where you enter your bank details (card number, expiry date and security code), the URL becomes "https" (the "s" indicating that the page is secure and encrypted) rather than an "http" address.
- Cheque made payable to ORFEVA
Payment by cheque is made exclusively by post to the following address:
ORFEVA - Manufacture Mayaud
69 boulevard de Sébastopol
75002 – PARIS
The order will be taken into account once the payment has been validated by our bank.
Article 9: Complaints
In the event of a complaint, the customer must submit their request by post within fourteen days of receiving the goods.
Article 10: Guarantees
Items sold on manufacturemayaud.fr by ORFEVA are guaranteed for two years against all hidden defects (excluding gold-plated items).
- The 2-year guarantee takes effect from the day the customer receives the item.
- The guarantee is 6 months for gold-plated jewellery.
ORFEVA - Manufacture Mayaud undertakes to exchange or refund any item with hidden defects. Refunds will be made, as applicable, by credit to the bank account or in the form of a credit note to be used on the website.
Photographs are not contractual: there may be a discrepancy between the photographic description of the product and its exact nature.
Article 11: Confidentiality
ORFEVA guarantees the confidentiality of the personal information entered.
In accordance with French Law No. 78-17 of 6 January 1978 on data processing, files and freedoms, the customer has the right to access and rectify data concerning them.
Article 12: Intellectual property
All elements of the manufacturemayaud.fr website, whether visual or audio, including the underlying technology, are protected by copyright, trademark and patent law. They are the exclusive property of ORFEVA.
Any user who has a personal website and wishes to place, for personal use, a simple link on their site pointing directly to the home page of manufacturemayaud.fr must request permission from ORFEVA, trading as Manufacture Mayaud.
In all cases, any link, even one tacitly authorised, must be removed upon simple request by ORFEVA.
Consequently, the partial or total reproduction on any medium whatsoever of the elements making up the website, their use and their provision to third parties are strictly prohibited and will systematically result in legal proceedings.
Article 13: Applicable law
These terms and conditions of sale are governed by French law.
Article 14: Jurisdiction clause
Any disputes arising from the contractual relationship between ORFEVA and its customers shall fall under the jurisdiction of the courts of Paris.
